The terms of the contract will supersede any general provisions in these Terms of Service if there is a conflict. The estimate or quote for the work is based on the information provided by the client and may be subject to change due to unforeseen conditions, project scope alterations, or other factors.4. Client ResponsibilitiesYou agree to:Provide accurate and complete information about the project requirements, including any relevant plans, specifications, and approvals.Ensure that the site where construction work is to take place is accessible, safe, and properly prepared for the work to begin.Obtain any necessary permits or approvals required for the project (unless otherwise specified in the contract).Cooperate with PB and Sons Construction and any subcontractors we engage to complete the project.Pay all invoices on time according to the agreed-upon payment schedule.5. Payment TermsAll services provided by PB and Sons Construction are subject to the agreed-upon payment terms. Payment may be required in stages based on the completion of project milestones. We accept various payment methods, including credit/debit cards, checks, or bank transfers. Specific payment terms will be outlined in your contract.Late payments may incur additional fees and charges. If payment is not received within the specified time, we reserve the right to halt work until payment is made.6. Changes to the Project ScopeIf there are any changes or additions to the scope of work once the project has begun, both parties must agree to these changes in writing. Additional costs and time may be incurred depending on the nature of the changes, and we will provide an updated estimate for approval before proceeding with any modifications.7. Limitation of LiabilityPB and Sons Construction is committed to delivering high-quality work. However, in no event shall we be liable for any indirect, incidental, or consequential damages, including lost profits, loss of use, or property damage, arising from or related to the services we provide.Our total liability for any claims, damages, or losses related to the project shall be limited to the total amount paid by the client for the specific services that are the subject of the claim.8. IndemnificationYou agree to indemnify and hold PB and Sons Construction, its employees, agents, subcontractors, and affiliates harmless from any claims, damages, liabilities, or expenses (including legal fees) arising out of your breach of these Terms, your negligence, or any other wrongful act or omission on your part related to the project or use of our services.9. Intellectual PropertyAll intellectual property, including but not limited to designs, blueprints, plans, and other materials created by PB and Sons Construction during the course of a project, remain the property of PB and Sons Construction unless otherwise agreed in writing. Upon full payment for the project, you may receive ownership or license to use specific project deliverables as outlined in your contract.10. ConfidentialityBoth parties agree to keep any confidential information received during the course of the project confidential and not to disclose such information to any third parties, except as required by law or with the prior written consent of the other party.11. Termination of ServicesEither party may terminate the agreement under the following conditions:By You: You may terminate the agreement with written notice if PB and Sons Construction fails to meet the terms of the contract or delivers substandard work that is not rectified.By PB and Sons Construction: We may terminate the agreement if you fail to meet your obligations, such as failing to make timely payments or not providing access to the construction site.In the event of termination, you agree to pay for all work completed up until the termination date.12. Force MajeurePB and Sons Construction shall not be held liable for any delays or failure to perform due to circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, or government restrictions.13. Dispute ResolutionIn the event of any dispute or claim arising from the use of our services or these Terms, we encourage both parties to resolve the matter through informal negotiation.
